These Terms of Service (“Terms”) govern your access to and use of the AirwayZ website and educational platform, operated by TreatOrigin Productions, LLC (“AirwayZ,” “we,” “our,” or “us”), a Vermont limited liability company.

By accessing or using the AirwayZ platform, you agree to be bound by these Terms. If you do not agree, please do not use the website or services.

1.  About AirwayZ

AirwayZ is an educational platform designed to support airway health literacy and to facilitate communication between patients and healthcare providers. AirwayZ provides access to educational content, practice assessment tools, and information about the AirwayZ Patient Education System.

AirwayZ is not a medical provider. Nothing on this platform constitutes medical advice, diagnosis, or treatment. All clinical decisions should be made in consultation with a licensed healthcare professional.

2.  Scope of These Terms

These Terms apply to use of the public AirwayZ platform, including the website, educational content previews, practice readiness quizzes, ROI assessment tools, and contact and inquiry features.

These Terms do not govern the AirwayZ Patient Education System, which is a separate, provider-purchased product subject to its own purchase agreement, data handling terms, and applicable regulatory requirements. If you are a healthcare provider purchasing or operating the Patient Education System, separate terms apply.

3.  Educational Content

All materials available through the AirwayZ platform, including articles, videos, assessments, and graphics, are provided for informational and educational purposes only. They are intended to support discussions between patients and their healthcare providers and do not constitute clinical guidance.

Individual health needs vary. AirwayZ content does not replace the judgment of a qualified healthcare professional.

4.  Gated Content and Access

Certain educational materials, including video previews, are available only upon submission of a name and email address. By submitting this information, you agree to receive follow-up communications from AirwayZ. You may unsubscribe at any time.

Access links to gated content are for personal, non-commercial use only. You may not share, redistribute, or circumvent access controls for any AirwayZ content.

5.  Assessment Tools

AirwayZ offers practice readiness quizzes and ROI calculators as self-directed educational tools. Results are generated for on-screen reference only and are not stored, retained, or transmitted. These tools are illustrative in nature and do not constitute financial, clinical, or business advice.

6.  Intellectual Property

All content provided through AirwayZ — including videos, written materials, graphics, assessments, and platform features — is the property of TreatOrigin Productions, LLC or its licensors, and is protected by United States copyright law and applicable intellectual property protections.

You may access and view materials for your own personal, non-commercial educational use. You may not reproduce, copy, distribute, publicly display, create derivative works from, or share any AirwayZ content without prior written permission from AirwayZ.

Unauthorized redistribution of any AirwayZ content, including patient education videos, is strictly prohibited and may result in legal action.

7.  Acceptable Use

By using this platform, you agree not to:

• Violate any applicable local, state, federal, or international law

• Interfere with or disrupt the security or operation of the platform

• Attempt to access systems, accounts, or data beyond your authorized access

• Reproduce or distribute protected content without authorization

• Submit false, misleading, or fraudulent information through any platform form

AirwayZ reserves the right to restrict or terminate access for any user who violates these Terms.

8.  Relationship With Healthcare Providers

Some AirwayZ content is designed to be delivered by participating healthcare providers to their patients prior to scheduled appointments. The provider, not AirwayZ, controls the clinical relationship and the context in which materials are shared.

AirwayZ does not direct, supervise, or assume responsibility for the medical care provided by any healthcare professional. Providers who purchase and deploy AirwayZ products do so under their own clinical and professional judgment.

9.  No Warranty

The AirwayZ platform and all content are provided “as is” and “as available” without warranties of any kind, express or implied. AirwayZ makes reasonable efforts to ensure that platform content is accurate and current, but does not warrant that all information will be complete, error-free, or applicable to any specific situation.

AirwayZ does not guarantee uninterrupted access to the platform or any specific feature, and reserves the right to modify or discontinue any aspect of the platform at any time.

10.  Limitation of Liability

To the fullest extent permitted by applicable law, AirwayZ, TreatOrigin Productions, LLC, and their respective members, officers, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of or inability to use the platform or its content.

In no event shall AirwayZ’s total aggregate liability to any user exceed the greater of (a) the total amount paid by that user to AirwayZ in the twelve months preceding the claim, or (b) one hundred dollars ($100.00).

11.  Indemnification

You agree to indemnify, defend, and hold harmless AirwayZ, TreatOrigin Productions, LLC, and their respective members, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the platform, your violation of these Terms, or your infringement of any third-party rights.

12.  Third-Party Services

AirwayZ uses third-party service providers to support platform functionality, including hosting, marketing automation, and analytics. AirwayZ is not responsible for the independent policies or practices of those providers. Links to third-party sites, if any, do not constitute endorsement.

13.  Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Vermont, without regard to conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the platform shall be resolved exclusively in the state or federal courts located in Chittenden County, Vermont. You consent to the personal jurisdiction of those courts.

For disputes involving amounts under $10,000, AirwayZ may elect to resolve the matter through binding arbitration administered under the rules of the American Arbitration Association, conducted in Vermont. If arbitration is elected, the arbitrator’s decision shall be final and binding. This clause does not prevent either party from seeking injunctive relief in court to protect intellectual property or confidential information.

14.  Changes to These Terms

AirwayZ may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the platform after updates constitutes acceptance of the revised Terms.
